RE: The classification of a woman’s knit bodysuit and pullover from Hong Kong.

Dear Ms. Shira:

In your letter dated January 11, 2001, on behalf of your client Polo Ralph Lauren, you requested a classification ruling.

The submitted samples are described as follows:

Style #17988 – a woman‘s bodysuit constructed from 80% silk, 19% nylon, and 1% spandex knit fabric. The garment features a shirt type collar, an opening at the neck with a five-button closure, long sleeves with slit cuffs, and a snap crotch.

Style #17987 – a woman’s pullover constructed from 80% silk, 19% nylon, and 1% spandex knit fabric. The garment is sleeveless and features a round neckline, and a hemmed bottom. The outer surface of the garment measures more than 9 stitches per 2 centimeters in the horizontal direction.

We are returning your samples as you requested.

The applicable subheading for the Bodysuit, Style #17988, will be 6114.90.1060, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted, of other textile materials, containing 70 percent or more by weight of silk or silk waste, other. The rate of duty will be 2.4 % ad valorem.

Style #17988, Bodysuit, falls within textile category designation 759. Based on international textile trade agreements, garments of this category, imported from Hong Kong are not subject to a visa requirement or quota restraints.

The applicable subheading for the Pullover, Style #17987, will be 6110.90.1060, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted, of other textile materials, containing 70 percent or more by weight of silk or silk waste, other, women's or girls'. The rate of duty will be 2.4 % ad valorem.

Style #17987, Pullover, falls within textile category designation 739. Based on international textile trade agreements, garments of this category imported from Hong Kong are not subject to a visa requirement or quota restraints.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
